Rally Terms of Service
These terms are an agreement between you and Kyle Lieberbaum (“Rally”, “we”, “us”). By creating an account or using Rally you accept them. If you do not accept them, do not use Rally.
1. What Rally is
Rally introduces people through activities. You declare things you want to do and roughly when; you see people nearby who want to do the same; if you both like each other for that activity you can talk and agree a time and place. Rally provides the introduction and the tools to arrange it. It does not supervise, attend, or take part in whatever you arrange, and it is not a party to any arrangement you make.
2. Who may use Rally
- You must be at least 18 years old. There are no exceptions, and we terminate accounts that misstate age.
- You must be legally permitted to use a service like this where you live, and not barred from it by any previous suspension.
- You may hold one account. It is personal to you and you may not transfer or sell it.
- You must not have been convicted of a felony or an indictable offence involving violence or a sexual offence, nor be required to register as a sex offender.
- The information on your profile must be true and about you. Impersonating anyone is grounds for immediate termination.
3. Meeting people in person
Rally exists to help you arrange to do something with someone. Please take ordinary precautions: meet somewhere public the first few times, tell a friend where you are going and when, arrange your own transport, and leave if you are uncomfortable. Do not send money to anyone you have met here — requests for money are the most common form of fraud on services like this, and you should report them.

4. What you may not do
- Harass, bully, threaten, stalk, intimidate or defame anyone.
- Post nudity or sexually explicit content, or any content that sexualises a minor in any way.
- Post content that is hateful towards a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation.
- Post violent, graphic or otherwise objectionable content.
- Solicit money, advertise, recruit, promote a business, or use Rally for any commercial purpose.
- Use Rally for prostitution, trafficking, or any illegal activity.
- Share another person's private information, or anything from a conversation, without their permission.
- Create a false profile, use someone else's photos, or misrepresent your age, identity or intentions.
- Use bots, scrapers, or any automated means to access Rally, or attempt to circumvent its rate limits or security.
- Reverse engineer, decompile or interfere with the app or the systems behind it.
5. Reporting, blocking and enforcement
Every profile and every conversation has a control to report or block the person. Blocking is immediate and mutual in effect: it ends the match, cancels any plan between you, and prevents either of you from appearing to the other again.
We review reports of objectionable content and abusive users within 24 hours. We may remove content, limit an account, suspend it, or terminate it, at our discretion and without notice where the safety of someone else is involved. We may also report conduct to law enforcement where we believe it necessary.
If your account is terminated you may not create another.
6. Your content
Your photos, bio, notes and messages remain yours. To operate Rally we need your permission to use them: you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display your content, solely for the purpose of running and improving the service. This licence ends when you delete the content or your account, except for copies we must keep for safety or legal reasons and for content already shared with another person.
You confirm that you own or are entitled to share everything you post, and that it does not infringe anyone else's rights.
7. Plans, reliability and no-shows
Rally lets two people agree to meet, and afterwards asks each of them whether it happened. This record affects whether a “Shows up” badge appears on a profile. Only positive signals are ever shown to other people; your underlying score is never displayed and is not shown to you. Reporting falsely that someone did not turn up is a breach of these terms.
A plan arranged on Rally is an arrangement between two people. We are not a party to it and have no responsibility for what happens, including any cost either of you incurs.
8. Rally+ and payments
Rally+ is a paid membership. It is not currently on sale; nothing in the app charges you anything today. When it becomes available, subscriptions will be sold through the Apple App Store and governed by these terms together with Apple's.
When that happens: payment is taken by Apple at confirmation of purchase; subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours of the end of the period; you can manage and cancel subscriptions in your Apple ID settings; and any unused part of a free trial is forfeited when you buy a subscription. Refunds are handled by Apple under its own policies.
9. Ending the agreement
You may stop using Rally and delete your account at any time from Me → Settings → Delete account. Deletion is immediate and permanent.
We may suspend or terminate your account if you breach these terms, if we are required to by law, or if we stop offering the service. Sections that by their nature should survive termination — content licence for material already shared, disclaimers, limitation of liability, and dispute resolution — do survive it.
10. Service provided “as is”
Rally is provided as is and as available. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that you will find anyone, that anyone is who they say they are, that the service will be uninterrupted, or that it will be free of errors.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, you keep your statutory rights.
11. Limitation of liability
To the fullest extent permitted by law, Rally is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the service or from your interactions with any other person. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty units of your local currency.
12. Indemnity
You agree to indemnify Rally against claims arising from your content, your use of the service, your breach of these terms, or your interaction with any other person.
13. Disputes and governing law
These terms are governed by the laws of the State of Florida, without regard to conflict of laws rules, and the courts of the State of Florida have exclusive jurisdiction — except that if you are a consumer resident in the UK or EU, you may bring proceedings in your country of residence and the mandatory consumer law of that country still applies to you.

14. Apple App Store
These terms apply between you and Rally, not Apple. Apple has no responsibility for the app or its content.
- Your licence to use the app is a non-transferable licence to run it on an Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
- Rally, not Apple, is solely responsible for the app, its content, maintenance and support. Apple has no obligation to provide support.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. Apple has no other warranty obligation, and any other claims, losses, costs or expenses attributable to a failure to conform are Rally's responsibility.
- Rally, not Apple, is responsible for addressing any claim by you or a third party relating to the app, including product liability, failure to conform to a legal requirement, and consumer protection claims.
- Rally, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
15. Changes
We may change these terms. If a change is material we will tell you in the app before it takes effect. Continuing to use Rally after that means you accept the change.
